Plea Against HC’s Verdict on Bhojshala Case

The legal battle over the historic Bhojshala-Kamal Maula complex in Madhya Pradesh has now moved toward the Supreme Court after multiple groups challenged the recent verdict of the Madhya Pradesh

High Court. The case, which has generated nationwide debate over religious heritage and constitutional law, is entering a fresh and potentially decisive phase.

The Madhya Pradesh High Court, in its landmark ruling delivered on May 15, declared the Bhojshala complex in Dhar as a temple dedicated to Goddess Saraswati. The court also ended the long-standing arrangement that permitted Friday namaz at the site and directed the Archaeological Survey of India to oversee preservation of the monument. The verdict was based on historical records, ASI survey findings, and literary evidence presented before the court.

Soon after the judgment, the Muslim side formally approached the Supreme Court challenging the High Court order. The petitioners argued that the ruling ignored constitutional protections and raised concerns regarding the interpretation of the Places of Worship Act, 1991. The All India Muslim Personal Law Board also announced its support for the legal challenge and described the verdict as unacceptable.

Political reactions have further intensified the debate. Congress leader Digvijaya Singh criticized the judgment, stating that an ASI-protected monument should not be treated as an active religious place. He described the verdict as “vague” and questioned its legal interpretation.

The verdict has also triggered broader discussions around other disputed religious sites across the country. Several religious leaders welcomed the ruling and linked it to ongoing disputes in places like Kashi and Mathura, arguing that the Bhojshala decision could influence future legal battles.

Meanwhile, security arrangements in Dhar remain extremely tight. For the first time in over two decades, Friday namaz was not permitted inside the complex after the High Court ruling. Authorities deployed heavy police forces across the city to prevent any communal tension or unrest.

Legal experts believe the Supreme Court hearing may become significant not only for the Bhojshala dispute itself, but also for the wider interpretation of the Places of Worship Act and the future handling of similar religious disputes in India.
