Abhishek urges court to quash FIR

 Kolkata: Senior leader of Abhishek Banerjee has approached the court seeking the quashing of an FIR registered against him over an alleged poll speech delivered during the recent election campaign. 


The case has triggered fresh political debate in West Bengal, with the ruling party accusing opposition groups of misusing investigative agencies and legal mechanisms for political targeting.

According to legal sources, the FIR was filed over remarks allegedly made by Abhishek Banerjee during a campaign rally, where complainants claimed that portions of the speech violated election regulations and promoted political hostility. The complaint reportedly invoked sections related to public provocation and violations under election conduct norms.

In his petition before the court, Banerjee argued that the speech was political in nature and protected under democratic principles of free expression. His legal team reportedly stated that the FIR was “motivated, selective, and politically driven,” asserting that no criminal offence was made out from the speech when viewed in full context.

Counsel appearing for the Trinamool Congress leader also contended that political speeches during elections often involve criticism of opponents and strong rhetoric, which cannot automatically be treated as criminal conduct unless there is a direct incitement to violence or hatred. The petition further sought interim protection from coercive action while the matter remains under judicial consideration.

The state government’s representatives are expected to submit their response before the court in the coming hearings. Legal observers say the case may test the balance between electoral speech protections and the enforcement powers of election authorities during politically charged campaigns.

The issue has already drawn sharp reactions from opposition parties, with some leaders alleging that repeated controversial statements by political figures should face scrutiny under the law. Meanwhile, supporters of Banerjee claim the FIR reflects an attempt to suppress political dissent ahead of crucial political developments in the state.

The court is expected to hear the matter in detail later this week. No final order has yet been issued regarding the cancellation of the FIR.
